1. STAR SPORTS FPL CUP: The Premier League Star Sports Fantasy Premier League Cup 2021 (the “Star Sports FPL Cup”) is an online tournament, which is a game of skill, run via the Premier League’s Fantasy Premier League platform (the “Game”) and sponsored by the Football Association Premier League Limited, company number 02719699, of Brunel Building, 57 North Wharf Road, London, W2 1HQ (“Sponsor”). Star India Private Limited (“Administrator”), will administer the prizes for the Star Sports FPL Cup.
   
   
2. STAR SPORTS FPL CUP PERIOD: The Star Sports FPL Cup will begin on the deadline for Gameweek 21 of the Game (currently expected to be 11:00 GMT on Saturday 30 January 2021) and will end on the deadline for Gameweek 38 of the Game (currently expected to be 14:30 GMT on Sunday 23 May 2021).
   
   
3. ELIGIBILITY: The Star Sports FPL Cup is automatically open to the top 262,144 highest scoring managers in Gameweek 20 of the Game (the deadline of which is currently expected to be 16:30 GMT on Tuesday 26 January 2021) who are registered as a manager in the Game and have selected India as their country/region of residence (“Entrant”). Please see section 16 below for the separate eligibility requirements for receipt of a Prize (as defined below). If there are more than 262,144 highest scoring managers then there will be a random draw amongst the lowest scorers to determine who automatically qualifies. Employees (and/or consultants and/or persons hired on contract) of the Sponsor and/or Administrator and/or each of their respective subsidiaries, divisions, affiliates, advertising and/or promotional agencies and/or the immediate family members of the said employee (and/or consultants and/or persons hired on contract) (i.e. spouse, parents, siblings and children and mother- or father-in-law, son- or daughter-in-law, brother- or sister-in-law, as well as people (other than household employees) who permanently reside in a person’s home) are eligible Entrants and may participate in the Star Sports FPL Cup but are not eligible to win any Prizes (as defined below). The Star Sports FPL Cup and Entrants are subject to all applicable local laws. There is no entry fee and no purchase is necessary to enter the Star Sports FPL Cup.
   
   
4. If an Entrant is under the age of 18 (eighteen) years, parental or guardian consent must be obtained. Such consent must include a confirmation that the parent/guardian consented to the Entrant’s Entry to the Star Sports FPL Cup and they consent to the Entrant having the chance to be awarded a Prize (as defined below).
   
   
5. HOW TO ENTER: Entrants will be automatically entered into the Star Sports FPL Cup by the Sponsor (an “Entry”). No entrance procedure is required.
   
   
6. Entrants are only permitted to submit one Entry via their account. Any attempt by an Entrant to obtain more than one Entry by using multiple and/or different accounts, identities, registrations, logins, addresses or through any other methods, may void all of that Entrant’s Entries and that Entrant may be disqualified. Entries generated by script, macro or other automated means and entries by any means which subvert the Entry process are void. Incomplete, illegible and/or corrupt entries will not constitute a valid Entry.
   
   
7. Any content or portion of an Entry that is, in the Sponsor’s or the Administrator’s sole discretion, obscene, profane, lewd, defamatory and/or violates any proprietary right of any person living and/or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) and/or entity, sexual in nature, and/or is otherwise objectionable, will disqualify the Entry as determined in the Sponsor’s and/or the Administrator’s sole discretion. Entries must be in keeping with the Sponsor’s and the Administrator’s image and may not be offensive, as determined by the Sponsor or the Administrator in its sole discretion.
   
   
8. FORMAT OF THE STAR SPORTS FPL CUP: Each Entrant will be randomly drawn against another Entrant in the first round (commencing in Gameweek 21 of the Game). The winner (the team with the highest Gameweek score minus any transfer points), will progress to the second round and another random draw will take place. The loser is out of the Star Sports FPL Cup. This process continues until the final round when the two remaining Entrants contest for the Star Sports FPL Cup final, currently expected to take place in Gameweek 38 of the Game.
   
   
9. The Star Sports FPL Cup is part of the Game and the Entrants agree to be bound by and to abide by these terms and conditions, the terms of the Game (available at https://fantasy.premierleague.com/help/terms) and the Game Rules (available at https://fantasy.premierleague.com/help/rules).  In the event of any conflict between the Star Sports FPL Terms, the terms of the Game and Game Rules, the Star Sports FPL Terms shall prevail, solely in relation to the Star Sports FPL Cup.
   
   
10. In addition to the representation and warranties given under the said terms of the Game (available at https://fantasy.premierleague.com/help/terms), the Entrants represent and warrant that:
    a.     he/she is not on any Specially Designated Nationals and Blocked Persons List issued by the U.S. Treasury Department's Office of Foreign Assets Control.
    b.     he/she will not bring the Star Sports FPL Cup, the Sponsor and/or any of its clubs and/or the Administrator into disrepute.
11. DRAWING THE OVERALL WINNER: The overall winner of the Star Sports FPL Cup will be the Entrant who wins the final round of the Star Sports FPL Cup (the “Overall Winner”). If a cup match is drawn, then the following tie-breaks will be applied until a winner is found:
    -      Most goals scored in the Gameweek;
    -      Fewest goals conceded in the Gameweek; and
    -      Virtual coin toss.

In addition to the Overall Winner, the top 31 (thirty one) Entrants who finish after the Overall Winner in the Star Sports FPL Cup will be eligible to receive a Prize (as defined below) (the “Winners”).

12. THE PRIZE: Each Winner will receive one or more prizes from the following possible options: jerseys, footballs, goody bags and/or any other prize at the Sponsor’s and/or the Administrator’s sole discretion (the “Prize”).
    
    
13. The Prize is subject to availability and the Sponsor and/or the Administrator reserve the right to later amend, substitute or withdraw any element (including the criteria set for winning a Prize). The Prize (and each component) is non-transferable and non-exchangeable and no cash alternative will be offered in any circumstance. The Administrator will not be responsible to accommodate any requests made by the Winners in relation to the Prizes. If the Winner refuses to accept the Prize, the Administrator shall be released from all obligations towards the Winner(s) in connection to the Prize or otherwise.
    
    
14. WINNERS NOTIFICATION: The Winners will be notified by the Sponsor via email, as stated in their account used to play the Game, within 7 (seven) days of the relevant Gameweek in which they have been eliminated from the Star Sports FPL Cup. The Sponsor will provide the Winners with the Administrator’s email address on which the Winners should write to claim the Prize. The Sponsor will also provide each Winner with a unique identification number (“UIN”) which they must use to claim their Prize from the Administrator.
    
    
15. The Winners must send an email to the Administrator with their UIN within 28 (twenty eight) days of the issuance of the email by the Sponsor providing the Winners with the UIN. If two Winners reach out to the Administrator with the same UIN then both will become ineligible for the Prizes. If a Winner does not reach out to the Administrator with its UIN within the aforesaid timeline, the Administrator shall not be liable to award the Prizes to such Winner.
    
    
16. Once the Winner provides the UIN to the Administrator within the aforementioned timeline, the Administrator will request the Winners to provide the following information:
    a.     their name;
    b.     their age;
    c.     their address in India;
    d.     an address in India for receipt of the Prize;
    e.     proof of residency in India;
    f.     a copy of government issued ID as proof in support of each of the above items;
    g.     their contact number;
    h.     signed confirmation that they are not employees (and/ or consultants and/or persons hired on contract and/or the members of their immediate family) of the Sponsor, the Administrator and/or their respective subsidiaries, divisions, affiliates, advertising and/or promotional agencies; and
    i.     their favourite Premier League team (which shall be among the 20 teams playing in the 2020/21 season of the Premier League) along with their clothing size and the gender they identify This is applicable for only those Winners who may win any jerseys, shorts and socks, subject to the criteria determined by the Administrator.

17. If a Winner is under the age of 18 (eighteen) years, such Winner shall also share the above information and documents (set out in section 16(a) to (h)) of their parent/guardian along with their email address with the Administrator and share a signed confirmation from their parent/guardian that they have consented to the:
    a.     Entrant’s Entry to the Star Sports FPL Cup.
    b.     Winners receiving the Prize.
    c.     Transfer of personal information by the Administrator to the third party vendor as provided in section 24.

The Administrator may reach out to such parents/guardians for further confirmations if required.

18. If a Winner cannot fulfill any of the Prize Eligibility or do not provide the above information and/or documents (set out in sections 16 and 17) within 7 (seven) days of the issuance of such email requesting information and/or documents by the Administrator, such Winner shall be deemed ineligible to receive a Prize. The Administrator shall not be liable to award the Prize to any other Entrant.
    
    
19. The Sponsor and/or the Administrator may reach out to the Winners and/or their parents/guardians (if applicable) for further queries on the information and documents provided by them. If Winners and/or their parents/guardians (if applicable) do not provide all the required information and/or documents within 7 (seven) days of the issuance of such email requesting information and/or documents by the Sponsor and/or the Administrator (as the case may be), the Winner shall be deemed to have forfeited the Prizes. In such an instance, the Administrator shall not be liable to award the Prize to any other Entrant.
    
    
20. If at the time of submission of the information and/or documents by a Winner it is found that:
    a.     a Winner is not a resident of India; or
    b.     the address provided for receiving the Prizes is located outside of India,

such Winner shall be deemed be ineligible to receive the Prize. In such an instance, the Administrator shall not be liable to award the Prize to any other Entrant.

21. GENERAL RULES: If a Winner is uncooperative, disruptive, and/or may and/or does cause damage to person, property, or the reputation of Sponsor, Administrator and/or otherwise violates the policies of the Sponsor and/or Administrator, the Sponsor and/or the Administrator have the right, in their absolute discretion, to disqualify a Winner without compensation. Each Winner will remain solely responsible for all taxes and other expenses related to the Prize, if any.
    
    
22. In the event of any aspect of the Prize is cancelled or postponed due to circumstances beyond Sponsor’s and/or Administrator’s control, including but not limited to, travel cancellations, delays and/or interruptions due to acts of God, acts and advice of Governments, acts of war, epidemic, pandemic, natural disasters, weather, acts of terrorism, national catastrophes, advice against any travel by any Government and/or official authority for any reason (including by way of example only and without limitation by reason of any actual or potential terrorist threat) and/or the World Health Organisation and/or any internationally recognised medical authority for any reason and/or an event of force majeure, the Sponsor, the Administrator and its agencies will not be responsible and that portion of the Prize will not be awarded and no additional compensation will be provided. Any and all state and/or local income and other taxes on the prize is each Winner’s sole responsibility.

23. All information and personal data shall be controlled by the Sponsor in accordance with its privacy policy which can be found at https://www.premierleague.com/privacy-policy. To the extent that any information contained within an Entry constitutes personal data (as defined in the Data Protection Act 2018) is disclosed in relation to the Star Sports FPL Cup, the Sponsor shall ensure that they and all their agents observe the requirements of the Data Protection Act 2018 and the General Data Protection Regulation (and any amendments, schedules or revisions thereto) and shall protect the security, privacy and integrity of the personal data and personal data shall only be processed in accordance with these terms and conditions or the instructions of the Sponsor. The Sponsor shall use the information in the Entry for the purposes of administering the Star Sports FPL Cup only and no personal data shall be used for direct marketing (subject to section 25 below), nor will any personal data be passed onto any third parties, except for the Administrator and/or a third party vendor engaged by the Administrator as explained below in section 24.
    
    
24. The Winner and the parents/guardians of the Winners who are below the age of 18 specifically consent that the personal information of the Winners including their name, contact number, address and, if applicable, their favourite Premier League team along with their size and gender shall be transferred by the Administrator to a third party vendor engaged by the Administrator for the purpose of production, sourcing and distribution of the FPL Prizes.
    
    
25. By submitting an Entry, each Winner grants to the Sponsor and the Administrator a royalty-free, non-exclusive, perpetual licence to edit, publish, translate, modify, adapt, make available and distribute any element of their Entry throughout the world in any media now known or hereafter invented. For the avoidance of doubt, the Sponsor and/or the Administrator may make use of each Winner’s Entry, their name and country of residence online and in print, or in any other media, in connection with the Star Sports FPL Cup, without payment or compensation, except where prohibited by law.

26. The Sponsor and/or the Administrator shall not be liable or responsible for errors in the administration or fulfilment of the Star Sports FPL Cup, including without limitation mechanical, technical human, printing, distribution or production errors. The Sponsor and/or the Administrator shall be ultimately responsible for determining eligibility, in their sole discretion. In the event of any breach by an Entrant of these Star Sports FPL Terms, the Administrator and/or the Sponsor reserve the right in their sole discretion to not award any Prize.
    
    
27. Each Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Star Sports FPL Cup or use or redemption of prize. Notwithstanding anything contained in section 30 below, the Sponsor and/or the Administrator cannot accept any liability to any Entrant for any of the following types of loss which an Entrant may suffer as a result of their Entry:
    a.     loss which was not foreseeable to an Entrant, the Administrator and/or the Sponsor when the Entrant first entered any of the Star Sports FPL Cup (even if that loss results from the Sponsor’s and/or the Administrator’ failure to comply with these terms and conditions or its negligence);
    b.     any business loss an Entrant may suffer, including loss of revenue, profits, or anticipated savings (whether those losses are the direct or indirect result of the Sponsor’s and/or Administrator’s default);
    c.     loss which an Entrant suffers other than as a result of the Sponsor’s and/or Administrator’s failure to comply with these terms and conditions (to the extent such terms and conditions are applicable to the Sponsor and/or the Administrator) and the Sponsor’s and/or Administrator’s negligence or breach of statutory duty (to the extent such negligence and/or breach is attributable to the Sponsor and/or the Administrator); or
    d.     losses that are indirect, consequential, special, exemplary or punitive.
    
    
28. It is clarified that the Administrator shall have no liability towards the Winners if jerseys, shorts or socks of their favorite Premier League team and/or as per the Winner’s size cannot be distributed by the Administrator for any reason whatsoever. The Administrator shall not be responsible or liable for any technical disruption, failure and/or any other difficulties of such nature, due to which the Winner(s) is unable to claim the Prize from the Administrator. The Administrator shall not be liable for any delay in receipt or non-receipt of any Prize by any Winner, including due to errors or failures or deficiencies in dispatch services, in address details provided by the Winner and/or in the UIN provided by the Sponsor. After dispatch of a Prize to a Winner, in case any loss and/or damage is caused to or incurred by the Prize(s) during transit or otherwise, the Administrator will not be liable for any such loss and/or damage. The Administrator shall have no liability towards the Entrants for mental and/or emotional trauma and/or disappointment incurred or suffered by him/her in any manner whatsoever including as a result of entering the Game (including the Star Sports FPL Cup) or accepting a Prize. In the event of any fault, misunderstanding or dispute concerning any part of the Prize the decision of the Administrator shall be final.
    
    
29. All Prizes are provided on an as-is where-is basis without assurances or warranties of any kind. The Administrator does not provide any assurances or guarantees regarding the Prizes, including quality, merchantability or fitness for purpose. The Administrator shall not be liable for any delays and/or failures in any notifications or the Star Sports FPL Cup in general. The Entrants (including Winners) agree and acknowledge that the Administrator has no role in conducting the Star Sports FPL Cup and has been engaged by the Sponsor only to award the Prizes and promote the Star Sports FPL Cup. Accordingly, the Administrator shall not be liable for any failure, inaccuracy, and/or any other defect or deficiency in the Star Sports FPL Cup.
    
    
30. Nothing in these terms will limit the Sponsor’s and/or the Administrator’s liability for death or personal injury arising from (a) its negligence (to the extent such negligence is attributable to the Sponsor and/or the Administrator) and/or ; (b) the fact that the Sponsor and/or Administrator deliberately lied to Entrants before an Entry was submitted (to the extent such lie is attributable to the Sponsor and/or the Administrator).
    
    
31. In the event of any breach by an Entrant of these terms and conditions, the Sponsor reserves the right to:
    a.     refuse entry into the Star Sports FPL Cup; or
    b.     disqualification from the Star Sports FPL Cup.
    
    
32. These Star Sports FPL Terms may be amended or modified, or new conditions may be imposed, at any time, including for the purpose of complying with applicable law. Any such changes or additions will be reflected by an update of this page. Please check these Star Sports FPL Terms periodically for changes. An Entrant’s continued use of the Star Sports FPL Cup following the posting of changes to these Star Sports FPL Terms will mean he/she accepts those changes and that such changes shall apply to an Entrant’s use of the Star Sports FPL Cup after such changes have been posted.
    
    
33. APPLICABLE LAWS AND JURISDICTION: The Star Sports FPL Cup and these terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
    
    
34. ANNOUNCEMENT OF WINNER AND DETAILS OF PRIZES: Confirmation of the Winners will be shared on the Administrator’s social media pages, the details of which will be informed to the Entrants through prominent notifications on the Sponsor’s website (available at https://www.premierleague.com/home) (or at such other page or website that the Sponsor may notify to the Entrants by prominent notifications on its website) once each Winner has formally accepted the Prize. Any request for further information should be made by via the Entrant’s account. The details of the Prizes will be published on the website of the Sponsor (available at https://www.premierleague.com/home) or at such other page or website that the Sponsor may notify to the Entrants by prominent notifications on its website.
